OUR PRIVACY POLICY

  • About This Privacy Policy

The Business Improvement Company Limited, referred to as TBIC, we, us or our, respects the privacy of people whose information we handle.

This Privacy Policy explains how we collect, use, store, disclose and protect personal information in connection with TBIC, our website, the Better Business App™ and associated services.

We handle personal information in accordance with the New Zealand Privacy Act 2020 and other applicable privacy obligations.

  • Information We May Collect

Depending on how you interact with us, we may collect information such as:

Your name.

Business name.

Job title or role.

Email address.

Telephone number.

Account and login information.

Business Workspace membership and permissions.

Communications with TBIC.

Subscription and billing information.

Support enquiries.

Usage and technical information.

IP address, browser, device and security information.

Information submitted through website forms.

Information uploaded to or created within the Better Business App.

Other information reasonably necessary to provide our services.

We generally do not need to store complete payment card details. Payments may be processed directly by Stripe or another payment provider.

  • Your Business Information

You own your business information. We own ours.

Information, documents and other original business content that you bring to the Better Business App, or create about your business while using it, remain yours.

Storing information in the Better Business App does not transfer ownership of that information to TBIC.

We use and process your information only as reasonably necessary to provide, operate, maintain, secure and support our services, or as otherwise permitted or required by law.

If you leave our shores, you can take yours with you.

Where the Better Business App provides an export facility, authorised users can use it to retrieve their business information and uploaded files in sensible, usable formats where reasonably practicable.

  • Information About Other People

Businesses may enter information about other people into their Business Workspace.

This may include employees, contractors, customers, suppliers or other people connected with the business.

The business placing that information in the App is responsible for ensuring it has lawful authority to collect, use and provide that information and for giving any privacy notices it is required to provide.

TBIC processes that information as reasonably necessary to provide, secure, maintain and support the Better Business App.

Where TBIC collects personal information indirectly and Information Privacy Principle 3A of the Privacy Act 2020 applies, we will take reasonable steps to comply with the applicable notification requirements or a lawful exception.

  • Why We Collect and Use Information

We may use personal information to:

Provide and operate the Better Business App.

Create and administer accounts and Business Workspaces.

Authenticate users.

Manage roles, permissions and access.

Process subscriptions and payments.

Provide customer support.

Communicate about the service.

Maintain security.

Detect fraud, misuse or unauthorised access.

Improve our products and services.

Understand service performance.

Maintain appropriate business and accounting records.

Comply with legal obligations.

Protect TBIC, our customers and users.

Enforce our agreements and legal rights.

We will not use personal information for unrelated purposes unless authorised or permitted by law.

  • How We Obtain Information

We may collect information:

Directly from you.

From another authorised person in your business.

When a business adds you to its Business Workspace.

Through the Better Business App.

Through our website.

Through communications with us.

Through payment and service providers.

Automatically through the normal operation and security of our digital services.

Where information is collected from another source, we will comply with applicable requirements of the Privacy Act 2020.

  • Marketing Communications

We may send information about TBIC products, services or relevant business information where we have a lawful basis to do so.

Commercial electronic messages will include an appropriate way to unsubscribe where required by law.

You can ask us to stop sending marketing communications at any time.

Service communications concerning your account, security, payments or operation of the Better Business App are not marketing communications and may still be sent where necessary.

  • When We May Share Information

We do not sell personal information.

We may disclose or provide access to information where reasonably necessary to:

Operate the Better Business App.

Provide hosting, storage, authentication, email, payment, support and other technology services.

Work with professional advisers.

Protect security and prevent fraud, abuse or unauthorised access.

Comply with law, court orders or lawful government requests.

Enforce our legal rights.

Complete a legitimate corporate transaction subject to appropriate protections.

Service providers should receive access only to information reasonably necessary for their role.

  • Overseas Processing and Disclosure

Some technology providers used by TBIC may process or store information outside New Zealand.

Where Information Privacy Principle 12 applies to an overseas disclosure, we will take reasonable steps to ensure the disclosure complies with the Privacy Act 2020, including using appropriate privacy protections or other lawful safeguards.

Using an overseas cloud or technology provider does not give that provider ownership of your business information.

  • Storage and Security

We take reasonable safeguards against loss, misuse, unauthorised access, disclosure, alteration and other misuse of personal information.

Measures may include authentication, access controls, Business Workspace separation, role based permissions, secure infrastructure, monitoring, backups and other technical and organisational controls appropriate to the service.

No system connected to the internet can guarantee absolute security.

  • Business Workspace Security

The Better Business App is designed so businesses operate within separate Business Workspaces.

Access may depend on a user's assigned role and permissions.

Customers are responsible for deciding who should have access to their Business Workspace and for removing or changing access when appropriate.

Users must keep their login credentials secure and must not allow unauthorised people to use their account.

  • Privacy Breaches

If a privacy breach occurs, we will assess and respond to it in accordance with the Privacy Act 2020.

Where a breach has caused or is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and affected individuals where required by law.

  • How Long We Keep Information

We retain personal information only for as long as reasonably necessary for a purpose for which it may lawfully be used.

Information may also be retained where reasonably required for legal, accounting, security, backup, dispute resolution, recovery or legitimate business purposes.

When information is no longer reasonably required, we may securely delete or anonymise it.

Ending a Better Business App subscription does not necessarily result in immediate deletion because information may need to remain available for export, recovery, reactivation or other legitimate purposes.

  • Accessing and Correcting Personal Information

Under the Privacy Act 2020, individuals may have the right to request access to personal information TBIC holds about them and ask for correction.

We may need to verify your identity before responding.

Some information in a customer's Business Workspace is operationally controlled by that customer. Where appropriate, we may refer a request to the relevant business or work with that business to respond.

  • Accuracy

We take reasonable steps to ensure personal information is accurate, up to date, complete, relevant and not misleading before using or disclosing it where required by law.

You can help by keeping your account and contact information current.

  • Cookies and Technical Information

Our website and digital services may use cookies and similar technologies for login, security, functionality, preferences, analytics and service improvement.

Some third party services may also use cookies or similar technologies according to their own privacy practices.

Where consent is legally required, we will seek it as appropriate.

  • Third Party Links

Our website and Better Business App may contain links to third party websites, services or resources.

TBIC is not responsible for the privacy practices of independent third parties.

You should review their privacy information where appropriate.

  • Children's Information

The Better Business App is designed for businesses and is not intended as a service for children.

We do not knowingly seek to collect children's personal information for independent use by TBIC unless there is a legitimate and lawful reason.

  • Changes to This Privacy Policy

We may update this Privacy Policy when our services, technology, business or legal obligations change.

The current version will be published on our website with its effective date.

Where appropriate, we will communicate material changes to affected users.
